Right of withdrawal 1. Pursuant to Article 5 of Legislative Decree 206/2005, if the customer is a consumer (i.e. a natural person who purchases goods for purposes not related to their professional activity, or does not make the purchase by indicating a VAT number reference in the order form to Babychicstore), they have the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except as indicated in the subsequent points 3 and 5.

2. To exercise this right, the customer must send a communication to babychicstore to that effect, within 10 working days from the date of receipt of the goods. This communication must be sent by email or chat. Once we have received the aforementioned withdrawal communication, Customer Service will promptly communicate to the customer the instructions on how to return the goods, which must arrive at babychicstore within ten days of authorization. The goods must be returned intact, complete with all their parts and in their original packaging (envelopes and boxes), stored and possibly used with normal diligence, without any signs of wear or dirt, in compliance with the conditions of the following points 3 and 5.

3. The right of withdrawal is in any case subject to the following conditions: the right applies to the product purchased in its entirety; it is not possible to withdraw only from part of the product purchased (e.g. accessories, attached software, etc.); the right does not apply to audiovisual products or sealed computer software (including those attached to hardware) once opened; the purchased item must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.); to limit damage to the original packaging, we recommend, where possible, to insert it in a second box; in all cases, the application of labels or adhesive tapes directly on the original product packaging should be avoided

  • by law, the shipping costs for returning the goods are borne by the customer; delivery costs to the customer and any other ancillary costs highlighted at the time of placing the order will also not be reimbursed;
  • the shipment, until the certificate of receipt in our warehouse, is under the full responsibility of the customer;
  • in case of damage to the goods during transport, babychicstore will notify the customer of the incident (within 5 working days from receipt of the goods in its warehouses), to allow them to promptly file a complaint against the courier they chose and obtain reimbursement of the value of the goods (if insured); in this event, the product will be made available to the customer for its return, at the same time canceling the withdrawal request;
  • babychicstore is in no way responsible for damage or theft/loss of goods returned with uninsured shipments;
  • upon arrival in the warehouse, the product will be examined to assess any damage or tampering not resulting from transport. If the packaging and/or the original packaging are damaged, babychicstore will deduct a percentage from the due refund, in any case not exceeding 30% thereof, as a contribution to the restoration costs.

4.Without prejudice to any restoration costs for ascertained damage to the original packaging, babychicstore will reimburse the customer the full amount already paid, within fourteen days of the return of the goods, by reversing the amount charged to the Credit Card or by Bank Transfer. In the latter case, it will be the customer's responsibility to promptly provide the bank details on which to obtain the refund (ABI - CAB code - Current account of the invoice holder).

The right of withdrawal is totally forfeited due to the lack of the essential condition of integrity of the goods (packaging and/or its content) in cases where babychicstore ascertains: careless use of the goods that has compromised their integrity or the use of any consumables, the lack of the external packaging and/or the original internal packaging; the absence of integral elements of the product (accessories, cables, manuals, parts, ...)

  • damage to the product for reasons other than its transport. In the event of forfeiture of the right of withdrawal, the goods will remain at the babychicstore premises available to the Customer for collection at their expense.
  • The cost of International Shipping is €50.00. This cost may vary following checks by the International Courier based on the type of product and the country of destination. Further additions to shipping costs are not directly attributable to Baby Chic and may vary from nation to nation. Customers who wish to receive products in a foreign country are strongly invited to contact us beforehand to ask for the precise cost of shipping.

Guarantees 6. All products sold by babychicstore are covered by the manufacturer's conventional guarantee and by the 24-month guarantee for conformity defects, pursuant to Legislative Decree 24/02. To benefit from warranty assistance, the Customer must keep the invoice (or the delivery note). The exercise of the Guarantee may involve requesting assistance from Authorized Service Centers in the area and/or following the procedures illustrated in the documentation inside the product packaging.

7. The manufacturer's conventional guarantee is provided according to the methods illustrated in the documentation inside the product packaging. If, following intervention by an Authorized Service Center, the defect should not be covered by the manufacturer's conventional guarantee, the Customer will be charged for any verification and restoration costs requested by the Authorized Assistance, as well as transport costs, if incurred by babychicstore.

8. The 24-month warranty pursuant to Legislative Decree 24/02 applies to products that present a conformity defect, provided that the product itself is used correctly, in compliance with its intended use and as provided in the attached technical documentation. This warranty is reserved for the private Consumer (natural person who purchases goods for purposes not related to their professional activity, or makes the purchase without indicating a VAT number in the order form). In case of a conformity defect, babychicstore will provide, at no cost to the Customer, to restore the conformity of the product through repair/replacement or to reduce the price, up to the termination of the contract. If, following intervention by an Authorized Service Center, the defect should not be a conformity defect pursuant to Legislative Decree 24/02, the Customer will be charged for any verification and restoration costs requested by the Authorized Assistance, as well as transport costs if incurred by babychicstore.

9. Replacements in case of DOA (Dead On Arrival: product not working on delivery) only occur if expressly provided by the manufacturer. The times for replacement or any repair of the product depend exclusively on the manufacturer's policies.

10. In the event that, for any reason, it is unable to return a product under warranty (restored or replaced) to its customer, it may, at its discretion, refund the amount paid taking into account the use of the goods or replace it with a product of equal or superior characteristics.

11. The times for repair or any replacement of the product depend exclusively on the manufacturer's policies and no damage can be claimed from babychicstore for any delays in carrying out repairs or replacements.

12. In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer in their original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.); to limit damage to the original packaging, we recommend inserting it in a second box; in all cases, the application of labels or adhesive tapes directly on the original product packaging should be avoided.

Approval
13. The seller declares that all products in the catalog and marketed comply with the standards and are approved according to the norms of the European Community. The seller is not responsible for any discrepancy with the standards of non-EU countries and/or their failure to approve the products themselves in said countries.

Privacy 14. The personal data requested when placing the order are collected and processed in order to satisfy the express requests of the Customer and will under no circumstances and for no reason be transferred to third parties. BabyChic Store guarantees its customers compliance with the regulations on the processing of personal data, governed by the privacy code referred to in Legislative Decree 196 of 30.06.03. The data controller is babychicstore.

Complaints 15. Any complaint must be addressed to babychicstore, within seven days of receipt of the goods.

Applicable law 16. The sales contract between the Customer and babychicstore is understood to be concluded in Italy and regulated by Italian Law. For the resolution of civil and criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the court of reference of their municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Naples.
