General Notes

  • These general terms and conditions of sale are governed by the Consumer Code (Legislative Decree No. 206/2005 and subsequent amendments) and by the regulations on e-commerce (Legislative Decree No. 70/2003 and subsequent amendments) and apply exclusively to distance sales via the web of products as identified and listed on the Website. In the event of changes to the Conditions of Sale, the Conditions of Sale published on the Website at the time the Order is placed by the Customer will apply to the purchase order, as specified in the "Public Offer" and "Prices" sections.

Public Offer

  • The Products available to the public on www.babychicstore.it, with their prices as shown on the Website, constitute a public offer in accordance with the procedures specified in the Conditions of Sale and on the Website itself. The conditions of this offer apply exclusively to purchases made on the aforementioned website. Purchase contracts concluded on the Website concerning the Products are concluded with TINYSTEPS S.R.L.S
  • Products identified as "Spare Parts" are always original and produced by the company indicated in the product sheet. Spare parts are the only products that may differ from the photo shown, as they depend on the specific company production.

Prices

  • All Product Prices indicated on the Website include VAT. Delivery costs, as indicated in the subsequent paragraphs of these Conditions of Sale, are, in some cases, borne by the Customer and adequately detailed in the Purchase Order. The Price indicated on the Website at the time the Order is placed will apply to the Products, without considering previous offers or subsequent price changes.

Availability

  • Products marked with "Available in 25 days" are not immediately available in our warehouses. The maximum waiting time to receive ordered products is 25 working days. If, during this period, the company informs Baby Chic of the temporary or permanent unavailability of a product, the customer will be promptly contacted and informed. Baby Chic Store is not responsible for products that are no longer orderable or unavailable from manufacturers.

Shipping costs

  • Following the order of one or more products on the website www.babychicstore.it, the customer must pay a price relating to the ordered and purchased product (See Prices section). The shipping cost is always €6.99.

Payment methods

  • Payment for the Order must be made at the time of placing the Order with BabyChic Store. As specified in more detail in the "Payments" section of our website, payment can be made cash on delivery, by bank transfer, or by credit card via PayPal. BabyChic Store will issue an invoice for the Purchase Order, sending it via email to the person named on the Order. If, within 48 (forty-eight) hours of confirming the Order, the person named on the Order does not receive the aforementioned invoice by email, they can contact BabyChic Store at the following link "Contacts". The information provided by the Customer will be used for invoicing. BabyChic Store, therefore, reminds the Customer to always check the accuracy of the information provided with the utmost care.

Product Guarantees

  • Legal Guarantees
  • a) Legal guarantee for Consumer Customers
  • The Consumer Customer (hereinafter, "Consumer"), as defined in art. 3 of the Consumer Code (hereinafter, "Consumer Code", Legislative Decree 6 September 2005, n. 206), has the right to avail themselves of the legal guarantee provided for by the Consumer Code itself in articles 128 to 132. This Guarantee provides, among other things, that the Consumer, under penalty of forfeiture, must report any lack of conformity found by the Consumer in the purchased product to BabyChic Store within 2 (two) months of discovery (art. 132, Consumer Code). Following such report, the Consumer will have the right to request the repair or replacement of the Product, without prejudice to other rights provided for by law in favor of the Consumer. By virtue of the aforementioned legal Guarantee, BabyChic Store is responsible for defects of conformity that appear within 2 (two) years from the Delivery of the Product. After this period, BabyChic Store will therefore not be responsible for defects of conformity found by the Consumer. In case of replacement or repair of the Product, the terms of the guarantee relating to the replacement product or resulting from the repair are the same as those of the original product. Therefore, the total two-year duration of the legal guarantee will in any case run from the Delivery of the original product. To benefit from the guarantee, we recommend showing the purchase document. In any case, for the regulation of the legal guarantee, reference is made to the provisions of the Consumer Code pursuant to articles 128 et seq.
  • b) Legal guarantee for Non-Consumer Customers (Professionals)
  • The Professional Customer, as defined in art. 3 of the Consumer Code, has the right to avail themselves of the legal Guarantee provided for in the Civil Code. This Guarantee provides, among other things, that the Non-Consumer Customer, under penalty of forfeiture, must report any lack of conformity found in the purchased product to BabyChic Store within 8 (eight) days of discovery. The aforementioned Legal Guarantee is valid for a maximum period of 12 (twelve) months from the Delivery of the Product. After this period, BabyChic Store will therefore not be responsible for defects of conformity found by the Non-Consumer Customer. To benefit from the guarantee, we recommend showing the purchase document.

Right of withdrawal

  • In the case of a purchase made via the internet, through the website www.babychicstore.it, if the Customer is a "Consumer", as defined in article 3 of the Consumer Code, they have the rights referred to in articles 52 et seq. of the Consumer Code, as amended by Legislative Decree no. 21 of 21/02/2014, and therefore the right to withdraw from the Purchase Agreement (hereinafter "Right of Withdrawal") for any reason, without explanation and without any penalty, in the manner specified below. The Withdrawal may concern all (Total Withdrawal) or only part (Partial Withdrawal) of the Products purchased by the Consumer from the BabyChic Store website. The Withdrawal period expires after 14 (fourteen) days from the day on which the Consumer or a third party, other than the Carrier and designated by the Consumer, acquires physical possession of the Product(s) (hereinafter "Withdrawal Period"). The right of Withdrawal is exercised by sending an email to the following address: assistenza@babychicstore.it or by means of a specific procedure in their user area.

  • For all products belonging to the category Baby Food, as these are sales of food products that "risk deteriorating or expiring rapidly" and are subject to alteration even as a result of improper storage, for hygiene and customer protection reasons, the right of withdrawal is not applicable. The right to return purchased goods is granted only for non-conformity of the order or products (i.e., for products or packaging clearly damaged upon delivery or incorrect quantities and/or type compared to the order).
  • The Withdrawal Communication must specify the will to withdraw from the Purchase and the Product or Products for which the right of Withdrawal is intended to be exercised. The Return of the Product(s) must take place within 14 (fourteen) days from the date on which the Consumer communicated their decision to withdraw pursuant to art. 52 of the Consumer Code. The deadline will be respected if the Consumer sends back or returns the Product(s) subject to Withdrawal before the expiry of 14 days. BabyChic Store reminds its Consumers that the transport costs related to the return of the Product(s) subject to Withdrawal are borne by the Consumer and that the Return is under the sole responsibility of the Consumer. BabyChic Store also reminds, before returning, to check that the Product(s) subject to Withdrawal is/are intact and in normal storage conditions, inserted in the original packaging, complete in all its parts (including packaging and accessory documentation). The Consumer, in accordance with current legislation, will be responsible only for the decrease in value of the Product(s) resulting from handling of the same other than that necessary to establish the nature, characteristics and functioning of the Product(s). If the right of Withdrawal has been correctly exercised as provided for in articles 52 et seq., BabyChic Store will refund the Consumer the amount already paid relating to the cost of the product. The Delivery Costs incurred by BabyChic Store will be withheld from the refund up to a maximum of 10% of the value of the products. The amount will be refunded using the same payment method used by the Consumer for the initial transaction, unless the Consumer expressly requests otherwise and provided that the Consumer does not incur any costs as a result of the refund. BabyChic Store, pursuant to and for the purposes of art. 56 of the Consumer Code as amended by Legislative Decree no. 21/2014, reserves the right to withhold the refund until it has received the Product(s) or until the Consumer has demonstrated that they have shipped the Product(s), whichever occurs first.

Shipments refused by the recipient

  • If, following an order contract made through the website www.babychicstore.it, the Consumer, for any reason, no longer wishes to collect the ordered product(s), they have the right to request a refund of what has already been paid. Shipping costs for both outbound and return, and any storage fees, will be deducted from the refund.

Technical Errors and Anomalies

  • BabyChic Store reserves the right to cancel, suspend, or modify orders received through its platform that contain technical errors, beyond the direct control of BabyChic Store. Errors may include:
    • Incorrect photos,
    • Incorrect descriptions,
    • Incorrect technical specifications,
    • Incorrect prices,
    • Incorrect discounts,
    • Incorrect shipping costs.
  • In each of these cases, BabyChic Store will promptly notify the customer, informing them of the problem that has occurred.
  • The presence of images that differ in some details from the received product is to be considered a technical error. The correspondence of the ordered/received product must be verified, in order of priority, with the following values:
    • product code,
    • EAN code,
    • technical sheet,
Only if all the parameters specified above do not correspond to the received product is it possible to request a return due to error.

Processing of personal data

  • Customer data is processed by BabyChic Store in accordance with the provisions of personal data protection legislation, pursuant to art. 13 of Legislative Decree no. 30/06/2003.

  • Any communication may be addressed to BabyChic Store using the contact channels listed in the "Contacts" section of the Website.

Competent court

  • It is understood that, in compliance with the provisions of art. 63 of Legislative Decree 206/2005, in the event of a purchase made by a natural person-consumer, as defined in art. 3 of the aforementioned decree, any legal disputes that may arise between the parties for reasons related to the commercial transaction concluded will fall under the territorial jurisdiction of the court of the consumer's place of residence or domicile, if located within the State.
